What to Do When Your Lease Expires: A Guide for Tenants

Many tenants often ask what happens after their lease expires and how much time they have to vacate the property. The answer has two aspects: how the law addresses this situation and how it is handled in practice.

How the law addresses this situation:

  • Lease expiration: According to the law, the tenant must return the property to the owner on the exact date the lease expires.
  • Renewal: If the tenant remains in the property after the expiration, it is considered a "renewal," and the lease becomes indefinite.
  • Termination: In the case of an indefinite lease, either party may terminate the lease with a written notice 15 days before the end of the calendar month.
  • Eviction: If the tenant does not vacate the premises after the termination, the owner may file a lawsuit for the recovery of the property.
  • Court ruling: The court ruling for the recovery of the property is temporarily enforceable, allowing the owner to evict the tenant immediately (3 business days after the notification).
  • Deadline: The court may grant the tenant up to 30 days to vacate the property after the ruling.
  • Compensation: The tenant owes compensation to the owner for the period they remain in the property after the expiration, equal to the current rental value.

How you should handle this situation in practice:

  • Discussion: Contact the owner to discuss your intentions.
  • Agreement: If you wish to stay, try to reach an agreement for a new lease.
  • Legal advice: In case of disagreement, seek legal advice on your rights.
  • Stay informed: Stay updated on legal procedures and timelines.

Tips:

  • Act promptly. Don't wait until the last minute to address the issue.
  • Communicate openly and honestly with the owner.
  • Be prepared for any legal procedures.
  • Respect the terms of the lease and the law.
