Renting a property in Greece is different from renting a simple object and has its own unique features. Let's look at the key points you need to know:

1. Duration:

A residential lease lasts for at least 3 years, even if a shorter period is agreed upon.

The 3-year period can only be reduced by a notarized document signed at least 6 months after the start of the lease.

2. Obligations:

Lessor:

  • Provides the tenant with the property in good condition, suitable for use.
  • Pays the charges and taxes of the property.
  • Compensates the tenant for necessary expenses incurred on the property.

Tenant:

  • Pays the agreed rent on the agreed dates.
  • Uses the property with care and according to the agreement.
  • Behaves appropriately towards other tenants.

3. Termination:

A fixed-term lease terminates automatically after 3 years if the minimum legal 3-year period has been agreed by the parties, or after the period agreed by the parties if it exceeds 3 years.

An indefinite lease is terminated by notice from one of the parties, with observance of the deadlines of the Civil Code.

If the property is a family home, notice to the spouse is invalid.

4. Additional Information:

The minimum 3-year period applies only to the lease of a main residence.

In the case of a secondary residence (e.g. holiday home), the duration is regulated by the Civil Code (CC).

Mixed use (e.g. residence and office) is covered by the protection of Law 1703/1987, if the residential use prevails.

Student housing: The applicability of Law 1703/1987 is disputed, with case law leaning towards its non-application.

Alternatively, student housing can be considered a special residence by analogy to Article 51(2) of the CC, offering protection to the student.

5. Tips:

  • Before signing the lease, read the terms carefully.
  • Make sure the property is in good condition and suitable for your needs.
  • Agree in writing on all the details of the lease.
  • Fulfil your obligations as a tenant.
  • In case of a problem, consult a lawyer for legal advice.
